  2. We, SRPS group including SRPS and SRPS Foundation herein with referred as SRPS are registered at C-17, Vidhya Nagar, Behind Domino’s Pizza, Hoshangabad Road, Bhopal (M.P.) – 462026. At SRPS Fintech Pvt. Ltd., we value your trust & respect your privacy. This agreement provides you with details about the manner in which you can access and user the service govern by SRPS in electronic manner.

  3. APPLICABILITY OF TERMS/ Agreement
  4. These Terms mentioned herein form the contract between the Users using the services offered by SRPS. By applying for job, inquiry and complaint, the User acknowledges and accepts these Terms of Service (Terms & Conditions).
    This “Agreement” constitutes a legally binding agreement by and between SRPS and you (“You” or “Your”) concerning your use of SRPS website located at https://srps.org.in/ (the “Website”). By using the Services, You represent and warrant that you have read and understand, and agree to be bound by, this Agreement.
    The term of this Agreement shall continue and would be in force till the time you access this services and you agree that you are bound by the terms as mentioned herein.
    Provisions of Rule 3 & (4) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of SRPS website.

    If you do not agree with the terms of this agreement, please do not use this Website.

  5. Definitions:-
  6. The following words and phrases shall have the meanings set out herein below in this document unless repugnant to the context:

    1. The terms "We" / "Us" / "Our"/”Company” individually and collectively refer to SRPS.
    2. The terms "You" /"Your" / "Yourself" refer to the users/subscribers.
    3. Confidential Information refers to the information obtained by the User through the website for availing various services through SRPS web solution.
    4. d) “Intellectual Property Rights” means any patents, utility models, designs, trademarks, service marks, trade names, copyrights, software, database rights, know-how and all rights having equivalent or similar effect anywhere in the world.
    5. e) "Mobile Number" shall mean the number registered by the User to apply for the job, Complaint, inquiry.
  7. Communications:

You understand and agree that our Services may include communications such as service announcements and administrative messages from us or from our partners or licensors or associates and that these communications are considered part of the Services. You will be able to opt out of receiving these messages. If you want to be opt out of service, you can contact the Grievance Officer through email or our grievance redressal mechanism.

  10. We may notify you via e-mail or any other communications means to contact information you provide to us in regards of query, complaint and job.

  11. Advertising:
  12. You also understand that our Services may include advertisements. The ads shown in our website may make users buy or carry out monetary transactions for third-party products or services. The Company shall not be responsible nor liable for any loss or claim that you may have against an advertiser or any consequential damages arising on account of your relying on the contents of the advertisement.

  13. Use of website
  14. You agree, undertake and confirm that your use of online web solution shall be strictly governed by the following binding principles

    1. 1. You shall not host, display, upload, modify, publish, transmit, update or share any information which:
      1. belongs to another person and to which You does not have any right to;
      2. B. is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, libelous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever; or unlawfully threatening or unlawfully harassing including but not limited to "indecent representation of women" within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986;
      3. is misleading in any way;
      4. is patently offensive to the online community, such as sexually explicit content, or content that promotes obscenity, pedophilia, racism, bigotry, hatred or physical harm of any kind against any group or individual;
      5. harasses or advocates harassment of another person;
      6. Involves the transmission of "junk mail", "chain letters", or unsolicited mass mailing or "spamming".
      7. Promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous.
      8. infringes upon or violates any third party's rights [including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person's name, email address, physical address or phone number) or rights of publicity]
      9. promotes an illegal or unauthorized copy of another person's copyrighted work (see "Copyright Complaintt" below for instructions on how to lodge a Complaintt about uploaded copyrighted material), such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
      10. contains restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page);
      11. provides material that exploits people in a sexual, violent or otherwise inappropriate manner or solicits personal information from anyone;
      12. provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
      13. .Contains video, photographs, or images of another person (with a minor or an adult).
      14. . tries to gain unauthorized access or exceeds the scope of authorized access to the app or to profiles, blogs, communities, account information, bulletins, friend request, or other areas of the app or solicits passwords or personal identifying information for commercial or unlawful purposes from other users;
      15. . interferes with another USER's use and enjoyment of the App or any other individual's User and enjoyment of similar services;
      16. Refers to any website or URL that, in our sole discretion, contains material that is inappropriate for the Website or any other website, contains content that would be prohibited or violates the letter or spirit of these Terms of Use.
      17. . harm minors in any way;
      18. infringes any patent, trademark, copyright or other proprietary rights or third party's trade secrets or rights of publicity or privacy or shall not be fraudulent or involve the sale of counterfeit or stolen products;
      19. violates any law for the time being in force;
      20. deceives or misleads the addressee/ users about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
      21. impersonate another person;
      22. . contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; or contains any Trojan horses, worms, time bombs, cancelbots, Easter eggs or other computer programming routines that may damage, detrimentally interfere with, diminish value of, surreptitiously intercept or expropriate any system, data or personal information;
      23. .Threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.
      24. shall not be false, inaccurate or misleading;
      25. . shall not, directly or indirectly, offer, attempt to offer, trade or attempt to trade in any item, the dealing of which is prohibited or restricted in any manner under the provisions of any applicable law, rule, regulation or guideline for the time being in force.
      26. shall not create liability for Us or cause Us to lose (in whole or in part) the services of Our internet service provider ("ISPs") or other suppliers;
  15. . Your Right to Opt out:-
  16. We provide all users with the opportunity to opt-out of receiving non-essential (promotional, marketing-related) communications from us. You have the right to opt out, but the electronic documents and information about the services used by the user in the past will be stored in our database for the purpose of record and compliance. As per digital personal data protection act, data of user will be deleted when we receive user request.

  17. Cyber Crime
  18. The Internet and digital application per se is susceptible to various cybercrimes like phishing, vishing, hacking, malware attack, compromise of User’s system security etc. that could affect various operation / other instructions to the SRPS. Whilst the SRPS shall endeavor to protect the interest of the Users, there cannot be any guarantee from such cybercrimes and other actions that could affect instructions to us. The User shall separately evaluate all such risks and the SRPS shall not be held responsible for the losses arising out of such cyber crimes.

  19. Technology Risks
  20. The Web portal or server of the SRPS may require maintenance and during such time it may not be possible to process the request of the users. This could result in delays and/or failure in the processing of instructions and other operation. The User understands that the SRPS disclaims all and any liability, whether direct or indirect, whether arising out of loss or otherwise arising out of any failure or inability by the SRPS to honor any user instruction for whatsoever reason.

  21. Indemnity
  22. In consideration of SRPS providing online web solution, the User, at his/their own expense, agrees to indemnify,

    • defend and hold harmless, SRPS, its directors and employees, representatives, agents, as the case may be, against all losses, damages, expenses, actions, claims, demands and proceedings whatsoever
    • Breach of Terms of Service (Terms & Conditions) mentioned herein.
    • Improper use of the SRPS and other services by the User.
    • Any claims made by third parties arising from issues related to any failure, delay or interruption of the services as provided by the SRPS services.
    • The use of products/ Internet Banking services in any manner which violates the Terms of Service (Terms & Conditions) or otherwise violates any law, rule, conditions or regulation
  23. Intellectual Property Rights
    1. The Client acknowledges and agrees that the online web solution provided by the SRPS shall constitute confidential and proprietary information of the SRPS and embodies the Intellectual Property Rights of the SRPS under relevant jurisdiction copyright and other laws and shall remain with the SRPS.
    2. The User shall not be entitled to use the name and logo of the SRPS. The User undertakes and confirms that it shall not infringe upon any of the Intellectual Property Rights of the SRPS.
  24. Amendments
  25. SRPS reserves the absolute discretionary right to make any amendments in the given terms and condition at any time as it may deem fit without any prior notice to the user. Any such amendment shall be communicated to the user by displaying on the website https://srps.org.in/; and the USER shall be bound by such amended terms and conditions. The User shall be responsible for regularly reviewing these Terms and Conditions. We without vitiating the evidence in any manner, preserve user information and associated records for one hundred and eighty days as per intermediary guidelines.

  26. Disclaimers.
  27. We disclaim any responsibility for the deletion, the failure to store, the untimely delivery of any information or material. We disclaim any responsibility for any harm resulting from downloading or accessing any information or material, services and quality of servers. While we strive to provide accurate and up-to-date information, we do not guarantee the accuracy, completeness, or reliability of any information provided through our financial inclusion services. Users are advised to independently verify any information before making financial decisions. The information provided through our financial inclusion services is for educational and informational purposes only and should not be construed as financial advice. All financial activities involve inherent risks, and users are solely responsible for evaluating and assuming these risks. We do not guarantee any specific outcomes or returns from utilizing our financial inclusion services. By accessing or utilizing our financial inclusion services, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions. If you do not agree with any part of these terms, you should not use our financial inclusion services.

  28. Dispute Resolution
  29. You and SRPS agree that the processes for dispute resolution described in this agreement will apply to any dispute or claims related to these Terms of Service, the Privacy Policy, or the Service. Disputes include any claims of any kind, including but not limited to legal, equitable, or statutory claims. Processes for dispute resolution will apply even if you stop using your Account, delete your Account, or stop using the Service. They will also apply to disputes that arose before we entered into this agreement. The User and The SRPS shall meet to resolve such dispute or difference and the joint decision shall be binding upon the parties hereto.

  30. ARBITRATION CLAUSE
  31. In case of failure of dispute resolution mechanism as contemplated under Clause 19 of this Agreement, then, the parties hereto or any person claiming on their behalf agree to refer the dispute of the arbitration tribunal consisting of one arbitrator nominated by each of the parties and an umpire appointed by such nominated arbitrators under "Arbitration and Conciliation Act. 1996". Both the parties agree that the decision of the arbitration tribunal shall be final and binding on the parties. It is also agreed that the seat of the arbitration still be in GWALIOR, M.P. India.

  32. Jurisdiction and Governing Law
  33. The construction, validity and performance of these Terms and Conditions shall be governed in all respects by the laws of India. The parties hereby submit to the exclusive jurisdiction of the competent Courts at Gwalior, India.
